Terms of Service

These Terms apply to workers, employers, employer administrators, and other authorised users of the WorkBridge marketplace.

1. Acceptance of these Terms

These Terms of Service govern access to and use of WorkBridge, including the website, marketplace, worker and employer accounts, job posting and discovery, applications, verification, messaging, notifications, reporting, work-completion, and payment-status features.

By creating an account, accessing authenticated features, posting a job, applying for work, or otherwise using WorkBridge, you agree to these Terms and the WorkBridge Privacy Policy.

If you do not agree to these Terms, you must not use WorkBridge.

2. About WorkBridge

WorkBridge is a SmartHelix platform operated by SmartHelix Technology Solutions in South Africa. WorkBridge provides technology that helps workers and employers discover opportunities, manage hiring workflows, communicate, record work outcomes, and track payment status.

Unless expressly agreed otherwise in writing, WorkBridge is a marketplace and technology service. It is not the employer of marketplace workers and does not become an employee, agent, partner, or representative of a worker or employer merely because they use the platform.

3. Eligibility and authority

You may use WorkBridge only if you are legally capable of entering into the relevant employment, work, or service arrangement and your use is permitted by applicable law.

If you create or manage an employer account on behalf of a business or organisation, you confirm that you are authorised to act for that organisation and to accept these Terms in connection with the account.

4. User roles and permissions

WorkBridge supports role-based access, including:

  • Workers, who may create profiles, discover opportunities, apply for work, communicate through permitted channels, and manage accepted work.
  • Employer users, who may discover talent and perform employer functions according to their assigned role.
  • Employer Owners and Employer Admins, who may manage additional employer operations, including job and payment-related controls where enabled.
  • WorkBridge Global or Super Admins, who may perform platform-level verification, moderation, governance, support, security, and operational functions.

Users may access only the functions authorised for their account. Attempting to bypass role restrictions or access another user’s data without permission is prohibited.

5. Account registration and security

You must provide accurate, current, and complete information during registration, onboarding, verification, and ongoing use of the platform.

You are responsible for:

  • Keeping your account and profile information accurate
  • Protecting access to your phone, email, OTPs, and authenticated sessions
  • Activity performed through your account
  • Promptly notifying WorkBridge of suspected unauthorised account access or misuse

WorkBridge may restrict, suspend, or investigate accounts containing false, misleading, incomplete, duplicated, compromised, or suspicious information.

6. Worker responsibilities

Workers agree to:

  • Provide truthful identity, profile, skills, experience, location, banking, and verification information
  • Apply only for opportunities they are genuinely able and willing to perform
  • Communicate respectfully and professionally
  • Submit accurate work-completion information and truthful supporting proof where required
  • Comply with applicable law, workplace rules, safety requirements, and lawful employer instructions
  • Not misrepresent qualifications, availability, identity, work completed, or payment details

7. Employer responsibilities

Employers agree to:

  • Provide accurate business, company, and contact information
  • Post lawful, genuine, clear, and truthful opportunities
  • Describe compensation, location, schedule, duties, requirements, and closing information accurately
  • Use applicant information only for legitimate hiring and work-management purposes
  • Review applicants and communicate professionally and fairly
  • Honour accepted job terms and payment obligations
  • Comply with applicable employment, labour, health and safety, anti-discrimination, tax, and other legal obligations relevant to the work
  • Not use WorkBridge for unlawful, misleading, discriminatory, abusive, exploitative, or unsafe activity

8. Job posts, review, and marketplace publication

Employers are responsible for the accuracy and legality of job posts they submit.

A submitted job may be held for WorkBridge review before it is publicly visible. WorkBridge may approve, reject, request changes to, suspend, close, archive, or remove a job where reasonably necessary for marketplace integrity, safety, compliance, or enforcement of these Terms.

Approval of a job post does not amount to an endorsement of the employer, job, compensation, or eventual work outcome.

9. Applications, shortlisting, and hiring decisions

Workers are responsible for the accuracy of their applications and supporting information.

Employers are responsible for applicant review, shortlisting, selection, rejection, and hiring decisions.

WorkBridge may provide match scores, ranking signals, profile-completeness indicators, verification status, analytics, or other decision-support information. These are informational tools and do not replace employer judgement or legal obligations.

10. Verification

WorkBridge may request identity, residence, banking, company, business, or other supporting information to verify users or marketplace activity.

Verification is a trust and governance measure based on information available at the time of review. It is not a guarantee of future conduct, competence, solvency, performance, payment, or suitability.

WorkBridge may approve, decline, revoke, or request additional verification where reasonably necessary.

11. Communication and chat

WorkBridge may provide application-scoped messaging or chat at designated stages of the hiring workflow.

Users must not use WorkBridge communications to harass, threaten, defraud, solicit unlawful activity, distribute malicious content, misrepresent work or payment terms, or collect personal information that is not reasonably required for the relevant work relationship.

WorkBridge may preserve, restrict, or review communications where reasonably necessary for support, safety, dispute handling, security, or enforcement.

12. Work completion and proof

Where WorkBridge provides work-status or proof-of-work functionality, workers and employers must submit and confirm information honestly and in a timely manner.

A platform status such as started, completed, proof submitted, acknowledged, payment pending, or paid reflects information recorded in the WorkBridge workflow. It does not by itself create or replace the underlying legal obligations between the worker and employer.

13. Payments

Unless WorkBridge expressly states that it is processing or holding funds for a transaction, payment obligations remain between the relevant employer and worker.

WorkBridge may record agreed amounts, payment references, due dates, payment status, supporting notes, and related workflow events to support visibility, reporting, audit, and dispute handling.

An employer must not mark a payment as paid unless the payment has genuinely been made through the stated payment method.

If WorkBridge introduces fees, payment processing, escrow, or other financial services, the applicable charges and additional terms will be disclosed before those services are used.

14. Reports and analytics

WorkBridge may provide employers and authorised administrators with reports and analytics relating to jobs, applications, engagement, accepted candidates, work outcomes, and operational activity within their permitted scope.

Analytics may depend on event availability, filters, user behaviour, connectivity, and system processing. They are provided as decision-support information and may not be complete in every circumstance.

15. Prohibited conduct

You may not:

  • Create false, duplicate, misleading, or fraudulent accounts
  • Misrepresent identity, employer status, qualifications, experience, availability, payment ability, job details, or work completed
  • Upload fraudulent, unlawful, malicious, or misleading documents or content
  • Harass, threaten, abuse, exploit, or unlawfully discriminate against another user
  • Circumvent access controls, verification, application, messaging, payment, or security workflows
  • Scrape, harvest, copy, probe, reverse-engineer, or misuse platform data or systems except where applicable law expressly permits it
  • Introduce malware, attempt unauthorised access, interfere with availability, or defeat security controls
  • Use WorkBridge to facilitate unlawful work, fraud, exploitation, unsafe activity, or other prohibited conduct

16. Platform moderation and enforcement

Where reasonably necessary, WorkBridge may:

  • Review, restrict, remove, or preserve content
  • Reject, suspend, close, or archive job posts
  • Request additional verification or supporting information
  • Restrict messaging, application, hiring, or administrative functionality
  • Suspend or terminate accounts
  • Investigate suspected fraud, security incidents, policy breaches, or unsafe activity
  • Retain records required for security, audit, dispute, legal, or regulatory purposes

17. Third-party services

WorkBridge relies on third-party infrastructure and service providers for functions such as hosting, authentication, storage, communications, notifications, monitoring, and related platform operations.

Third-party services may be subject to their own terms, availability, security controls, and technical limitations.

18. Platform availability and changes

We aim to keep WorkBridge reliable and available, but uninterrupted or error-free operation cannot be guaranteed.

We may maintain, update, improve, replace, suspend, or discontinue features where reasonably necessary for security, operations, compliance, product development, or service quality.

19. Intellectual property

WorkBridge, SmartHelix, the platform software, design, branding, documentation, workflows, and related intellectual property are owned by or licensed to the relevant rights holder.

You may use WorkBridge only for its intended marketplace and account purposes. You may not reproduce, commercialise, distribute, or create unauthorised derivative works from protected platform materials.

You retain ownership of content you lawfully submit. You grant WorkBridge a non-exclusive right to host, process, reproduce, display, and use that content to the extent reasonably necessary to operate, secure, and improve the service and comply with law.

20. Privacy and data protection

The WorkBridge Privacy Policy explains how personal information is processed and protected.

Users must handle personal information obtained through WorkBridge responsibly and only for the purpose for which access was provided.

21. Disclaimers

To the extent permitted by law, WorkBridge does not guarantee:

  • That a worker will be selected for a job
  • That an employer will receive suitable applicants
  • That any user will perform, pay, or behave as expected
  • That verification eliminates fraud, misconduct, or other risk
  • That rankings, reports, analytics, or availability information will always be complete or error-free
  • That a marketplace interaction will be free from disagreement or dispute

Users remain responsible for their own decisions, conduct, contracts, workplace obligations, and compliance with applicable law.

22. Limitation of liability

Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded or limited.

To the maximum extent permitted by applicable law, WorkBridge and SmartHelix will not be liable for indirect, incidental, special, or consequential loss arising solely from use of, inability to use, or reliance on the platform, except where liability cannot lawfully be excluded.

23. Suspension, termination, and account closure

You may stop using WorkBridge at any time and may contact us about account closure.

WorkBridge may suspend, restrict, or terminate access where you breach these Terms, provide materially false information, misuse the platform, create security or legal risk, fail required verification, or where restriction is required by law.

Account closure does not automatically erase records that WorkBridge is legally entitled or required to retain.

24. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa.

The parties should first attempt to resolve disputes in good faith through the relevant WorkBridge support or dispute process. Nothing in these Terms prevents a party from exercising rights available under applicable South African law.

25. Changes and contact

We may update these Terms to reflect changes in WorkBridge, applicable law, security, or operational requirements. Material changes will be published on the platform with an updated effective date.
